Article 1 – Applicability
These terms and conditions apply to all purchases via the website www.wauw.be.
The seller is WAUW.BE BV (hereinafter: 'Seller'). The buyer or customer is hereinafter referred to as 'Customer'. Together referred to as 'Parties'.
By placing an order, the Customer explicitly confirms to have read and accepted these general terms and conditions.
Article 1bis – Quality Standard
WAUW.BE sells only original and authentic vintage pieces. Where necessary, these are professionally checked and/or restored, preserving their authenticity.
The Customer has the option, before purchase, to request additional photos or videos to view the product from multiple angles.
As these are used items, normal signs of age or wear may be present. These are part of the unique character of the piece and are accepted by the Customer upon purchase.
Article 2 – Personal Data
The Customer has the right to access, modify, correct, or delete their personal data, as provided by GDPR legislation. Requests can be addressed to the Seller via the above contact details.
Article 3 – Prices and Orders
All prices on the website are listed in euros. If VAT applies, it is included.
Shipping costs are not included in the price and are clearly indicated before finalising the order.
The Customer places an order via the automated ordering process on the website.
The Seller reserves the right to refuse or cancel orders in case of suspected fraud, non-payment, or other irregularities, without any liability.
Cancellation by the Customer is only possible before payment has been completed.
Article 4 – Payment and Transfer of Ownership
Payments are made via the payment methods listed on the website (including Visa, Mastercard, Bancontact, and iDEAL).
Ownership of the product transfers to the Customer only after full payment has been received.
Article 5 – Delivery and Inspection
WAUW.BE works with an international network of transport partners to offer worldwide insured shipping by road, air, or sea at competitive rates.
Standard delivery is door-to-door to the ground floor. Delivery to other floors or requiring special access must be arranged in advance and may incur additional charges.
The quoted shipping costs do not include customs clearance charges, import duties, taxes, or other brokerage fees.

Delivery of the products is carried out by the Seller to the address provided by the Customer, to the person present at that location. At that moment, the transfer of risk also takes place. If absent, a delivery notice will be left with further instructions.
Immediately upon receipt, the Customer must inspect the products and report any complaints within 24 hours of delivery.
Article 5bis – Collection of Goods and Storage Period
If the Customer opts to collect goods instead of delivery, this will take place by appointment only, at one of the locations communicated by the Seller.
Purchased and paid goods will be stored free of charge for up to 30 calendar days after purchase. If the goods are not collected within this period, storage and insurance costs will automatically be charged at the following rate:
€30 excl. VAT (administrative fee) + €3 excl. VAT per additional calendar day and per item, unless otherwise agreed in writing with the Seller.
If the goods are not collected within 90 calendar days after purchase, the Seller reserves the right to resell or dispose of the item, in accordance with applicable legal provisions on uncollected goods. In that case, the Customer loses all rights to a refund or delivery, without prior notice of default.
Article 6 – Right of Withdrawal (for consumers within the EU only)
The consumer has a legal right of withdrawal of 14 calendar days after receiving the product, without giving any reason.
The Customer must notify the Seller of this decision in writing or by email within that period.
The product must then be returned within 10 calendar days of notification, at the Customer's expense, in its original condition and packaging, to:
WAUW.BE, Kortrijkstraat 210, 8550 Zwevegem, Belgium.
Upon correct and timely return, the Customer will be refunded the purchase price, excluding shipping costs, within 30 days.
Note: this right does not apply to professional customers or goods sold outside the EU.
Article 7 – Warranty
A 1-year legal warranty applies to second-hand goods if the Customer is a consumer.
A 2-year warranty applies to new products.
Any defect reported within 6 months of delivery is presumed to be a manufacturing defect. After that, the burden of proof lies with the Customer.
In the event of a valid defect, the Seller will, if possible, offer a free repair, replacement, or refund.
Article 8 – Liability and Force Majeure
The Seller is not liable for delays or failures caused by force majeure, accidental events, or third parties.
Vintage and second-hand goods may show signs of wear; the Customer expressly accepts the condition in which the object is found, as described and/or shown on the website.
Article 9 – Disputes and Applicable Law
All agreements are governed exclusively by Belgian law.
In case of dispute, only the courts of the judicial district of West Flanders, section Kortrijk, have jurisdiction.
Article 10 – Sales to Professionals
If the Customer is purchasing for professional purposes, the right of withdrawal does not apply. A different warranty period applies (e.g., 3 months for second-hand goods).
Article 11 – Purchases by Businesses
For purchases by businesses or professional clients (B2B), the statutory right of withdrawal does not apply. Orders are binding and cannot be cancelled, unless expressly agreed in writing with the Seller.
Article 12 – Transport Insurance and Damage Procedure
Transport insurance is not included as standard in the shipping costs. If the Customer wishes to take out transport insurance, they must inform WAUW.BE by email before shipping so that it can be arranged separately.
If the Customer chooses transport insurance, any damage must be reported to the Seller within 3 calendar days of delivery, accompanied by clear photos of the packaging and the product.
The original packaging and packing materials must be retained until the damage investigation is completed.
The Seller is not liable for damage during transport, but will assist the Customer as much as possible in submitting a claim to the carrier or insurer.
If the packaging materials or the damaged item are removed before the damage investigation is completed, any possibility of compensation from the carrier or insurer will lapse.
